This Part J only applies to the transfer of cryptocurrencies and related services (“Crypto Transfer Service”), provided exclusively by Red Dot Payment.
80. CRYPTO TRANSFER SERVICES - GENERAL
80.1 Under this Crypto Transfer Services provided exclusively by Red Dot Payment to you directly, you may from time to time transfer any Acceptable Tokens from your Custodian Account(s) to the Custodian Account(s), or Smart Contract Vault or wallets of other users or other third parties (each subject to KYC, KYT, or AML/CTF checks or the due diligence checks) to the extent they are not frozen or otherwise subject to any restriction on withdrawal, transfer or release in accordance with these Terms. Red Dot Payment may directly provide such Crypto Transfer Services or engage any appropriately licensed payment service providers (whether affiliated with us or not) (also "Third Party Payment Providers") in providing the Crypto Transfer Services, the selection of which is in our sole discretion depending on various factors, including without limitation, the prevailing fees, charges, etc. Any such withdrawal, release or transfer shall be effected in accordance with such instructions and procedures as may be prescribed by these Terms or as may be set out on the App or the Site (as applicable).
80.2 Red Dot Payment’s delivery obligations are satisfied upon the completion of its usual procedures to effect the transfer. All delivery of fiat currencies to you will be rounded down to the nearest 8 decimal places.
80.3 Red Dot Payment may, acting in good faith and in a commercially reasonable manner, refuse to accept or make (or accept or make on such terms as it may determine) any delivery of an Acceptable Tokens from you or to another party and it will provide notice of any such refusal as soon as reasonably practicable. In particular, we may refuse to accept any delivery of Acceptable Tokens that do not meet the pre-condition under Clause 3.3 from you.
80.4 Where withdrawal or transfer of Acceptable Tokens to third parties initiated by you are provided through Third Party Payment Providers, such withdrawal or transfer are facilitated by Red Dot Payment for your benefit and convenience. The relevant Third Party Payment Provider, and not Red Dot Payment, is responsible for providing the withdrawal or transfer service in relation to Acceptable Tokens directly to you as its customer. Accordingly, the terms and conditions apply in relation to any Third Party Payment Providers instructed through Red Dot Payment. Any such withdrawal or transfer instructions you provide through Red Dot Payment are provided by you to the relevant Third Party Payment Providers. Under Red Dot Payment’s arrangements with the relevant Third Party Payment Providers, Red Dot Payment act simply as a service provider to the Third Party Payment Providers to enable the integration between the Third Party Payment Providers' services and Red Dot Payment’s Services (including through the App) and, to enable you to deal with the relevant Third Party Payment Providers. It is the relevant Third Party Payment Provider that receives and processes any withdrawal or transfer instruction given by you through Red Dot Payment.
80.5 You consent to Red Dot Payment, the institution of your wallet or similar account, the institution of the third party’s wallet or similar account (if applicable), and the relevant Third Party Payment Provider disclosing to each other your (and third party’s, if applicable) personal information (including for example name, contact details and identification details) and the transaction details (including but not limited to the recipient details and transaction amount) for the purposes of the withdrawal or transfer of Acceptable Tokens through Red Dot Payment.
80.6 You also consent and agree to Red Dot Payment that you will provide updated details (including name, contact details and identification details) to the institution of your wallet or similar account, to the institution of the third party’s wallet or similar account (if applicable) and the relevant Third Party Payment Provider whenever you update details with Red Dot Payment or Red Dot Payment otherwise becomes aware that details have changed.
80.7 Collection, use and handling of any personal information by the institution of your wallet or similar account, the institution of the third party’s wallet or similar account (if applicable) and the relevant Third Party Payment Provider is subject to that that party's terms and conditions and privacy policy.
80.8 When you make a withdrawal or transfer request of Acceptable Tokens through Red Dot Payment: (a) you are instructing Red Dot Payment directly or through the relevant Third Party Payment Provider to process the transfer and must provide all the relevant information requested as directed through Red Dot Payment; and (b) you authorise Red Dot Payment to debit the amount of Acceptable Tokens necessary to complete the transfer from your Custodian Account and to pay it to the third party’s wallet or similar account (if applicable) directly or through the relevant Third Party Payment Provider on your behalf.
80.9 You are responsible for ensuring the accuracy of the destination of the relevant transfer information. Red Dot Payment shall not be liable to you or any other person in respect of any losses, damages or liabilities (including but not limited to tax liabilities) incurred as a result of any inaccurate transfer information.
80.10 You must notify Red Dot Payment immediately if you did not authorise a withdrawal or transfer related to a debit of Acceptable Tokens to your Account.
80.11 Red Dot Payment may set, vary or remove any limits on the withdrawal or transfer amount of Acceptable Tokens, frequency of withdrawal or transfer or other features relating to withdrawal or transfer of Acceptable Tokens, set by it from time to time at its sole discretion.
80.12 If the details of the institution of the third party’s wallet or similar account (if applicable) for receiving any Applicable Tokens from Red Dot Payment are incorrectly provided, such Applicable Tokens may be permanently lost and cannot be recovered at your own cost.
80.13 To the maximum extent permitted by Applicable Laws, Red Dot Payment will not be liable to you for any loss or damage you suffer as a result of linking to or accessing the services of the Third Party Payment Providers or instructing any withdrawal or transfer of Applicable Tokens through Red Dot Payment. For the avoidance of doubt, Red Dot Payment shall not be responsible to you for deficiencies in the provision of the Third Party Payment Providers' services or the manner in which these services are provided, and any direct or indirect loss or damage to you suffered as a consequence.
80.14 Red Dot Payment may decline, suspend or terminate your access to your withdrawal or transfer services in relation to Acceptable Tokens at any time for any reason whatsoever, including for compliance with Applicable Laws or if the third party are suspected of acting in a fraudulent or illegal manner. Red Dot Payment doing so will not affect your rights and obligations in respect of the relevant Third Party Payment Providers. Red Dot Payment is not required to notify you before it suspends the access to Acceptable Tokens of Third Party Payment Providers' services but will notify you within a reasonable period after it does so. Red Dot Payment may also notify the relevant Third Party Payment Providers.
80.15 Red Dot Payment reserves the right to charge a handling fee, network fees or other charges or expenses in relation to the processing of any aspect of the withdrawal or transfer of Acceptable Tokens set out in its prevailing relevant fee schedules, the App and the Site. You authorise Red Dot Payment to debit any handling fee and any other charges and expenses then due and payable by you from the withdrawal or transfer proceeds and/or any of your Account.
80.16 Red Dot Payment may vary any of these Terms applicable to the withdrawal or transfer of Acceptable Tokens, at any time by notice without giving reasons. Red Dot Payment will notify you of a variation through designated communication channels or in any other manner that it considers appropriate. To the extent that it is within Red Dot Payment control to do so, it will give you at least 30 calendar days’ prior notice (or such other notice period as permitted under Applicable Laws) of a change to any terms affecting any fees or charges, or your liabilities or obligations applicable to the withdrawal. If you still use the withdrawal or transfer services in relation to Acceptable Tokens prior to the effective date of a variation, then you will be bound by such variation accordingly.
