B. RedotPay Card

1. Application
1.1. These terms apply to your use of your RedotPay Card through a digital wallet and you agree to them by adding your RedotPay Card to a digital wallet. If you do not agree with any of these terms, you must cease all access to, or use of your RedotPay Card through the digital wallet and/or remove any RedotPay Card linked to your account from the digital wallet.
1.2. These terms supplement the RedotPay Card Terms and Conditions and, together, they govern your RedotPay Card. You must read these terms along with our RedotPay Card Terms and Conditions,RedotPay Privacy Policy and any other terms we may provide to you ("Other Terms"). These terms are in addition to any such Other Terms, and any transactions with your RedotPay Card through a digital wallet remain subject to any such Other Terms (as applicable).
1.3. If there is any inconsistency between the provisions of these terms and the provisions of our Other Terms, the provisions of these terms shall prevail for the purpose of the use of RedotPay Card through a digital wallet.
1.4. You may also be required to agree to your digital wallet provider's terms and conditions and their privacy policy. Those separate terms you agree with the digital wallet provider will not change or override these terms or our Other Terms. We have no control over your digital wallet provider's decisions to change their terms and conditions or privacy policy.
1.5. We may amend at any time these terms, by providing reasonable prior notice to you. We may revise these terms at any time by updating this posting. You are bound by such revisions and should therefore visit our website to review the current terms from time to time.
2. Definitions
For the purposes of these terms, unless the context otherwise requires, the following words and expressions have the meanings below:
"Intellectual Property Rights" including all patents, trade secrets, copyrights, trademarks and moral rights in a digital wallet (including text, graphics, software, photographs and other images, videos, sound, trademarks and logos) are owned either by the digital wallet provider, us, our licensors or third parties.
"Offer" has the meaning given to it in Clause 7.4.
"PIN" has the meaning given to it in Clause 4.1.
"Touch ID" has the meaning given to it in Clause 4.4.
Any term not defined in these terms has the meaning given to that term in the RedotPay Card Terms and Conditions.
3. Use of your RedotPay Card through a digital wallet
3.1. In order to enrol and use your RedotPay Card through a digital wallet on your device, you must:
3.2. We reserve the right to decline the enrolment of your RedotPay Card to a digital wallet at our sole discretion.
3.3. For an Account which contains multiple RedotPay Cards issuance, each RedotPay Card shall be regarded as separate, and thus be subject to separate enrolment, registration and verification individually. The digital wallet provider may also limit the number of cards that you may store in one digital wallet from time to time, which is beyond our control.
3.4. We have the right to specify or vary limits relating to the use of your RedotPay Card through a digital wallet at any time without prior notice, including:
3.5. Your RedotPay Card enrolled to a digital wallet can be used:
3.6. Your physical RedotPay Card, virtual RedotPay Card and RedotPay Card used through a digital wallet constitute one and the same card and share the same Account. All transactions with your RedotPay Card through a digital wallet will be recorded in your account statement covering the relevant period. There will not be a separate statement for transactions on your RedotPay Card used with a digital wallet.
3.7. We do not impose any additional fees for using your RedotPay Card through a digital wallet. However, you are solely responsible for any fees or charges imposed by third parties (such as your telecommunications provider) for your use of a digital wallet. For the avoidance of doubt, all applicable interest, fees and charges that apply to your RedotPay Card (if any) will apply to your use of your RedotPay Card through a digital wallet.
3.8. Subject to Applicable Laws, we may at any time, without giving you any prior notice or reason for doing so:

If we have cancelled, de-activated or suspended your RedotPay Card (whether pursuant to your request or otherwise), we will also disable your ability to use your RedotPay Card through a digital wallet. Please note that this is the case even though you may still see a symbol for your RedotPay Card in the digital wallet.
3.10. Nothing in these terms gives you any rights in respect of any Intellectual Property Rights owned by a digital wallet provider, us, our licensors or third parties and you acknowledge that you do not acquire any ownership rights by adding your RedotPay Card to, or using your RedotPay Card through a digital wallet.
4. Your responsibilities and liabilities
4.1. You are responsible for:
You must ensure that your enrolled device is not modified contrary to the software or hardware guidelines of the manufacturer or intentionally disabling the device's hardware or software controls (commonly referred to as "jailbreaking"). You acknowledge and agree that the use of a modified device to use your RedotPay Card through a digital wallet may be prohibited and constitute a violation of these terms, and may be grounds for us to deny your access to your RedotPay Card through a digital wallet. You should refer to the security advice we will provide you from time to time.
4.2. To protect your PIN:

If biometric identifiers are registered on your enrolled device and are used to identify you or be used to grant access to and use your RedotPay Card through a digital wallet, you must not save a third party's biometrics such as fingerprint (biometric information) on the device. In the event a third party's biometrics are saved on the device, whether now or in the future, and such biometric details can be used to grant access to the device to access and use your RedotPay Card through a digital wallet, you understand, acknowledge and agree that you will be taken to have authorised that person to transact on your behalf and the relevant transactions will be charged to your RedotPay Card, to which you shall be responsible and liable for the same.
4.4. If you enrol for biometric verification such as fingerprint identity ("Touch ID"), personal identification number or passcode on the use of RedotPay Card through a digital wallet, the collection, storage, enrolment and access to the digital wallet using your biometric information, personal identification number or passcode will be made using the technology on your compatible device. Accordingly, when you log into the digital wallet and choose to be verified using the technology on your compatible device, your fingerprint or any other biometric information, personal identification number or passcode will be matched and verified against your device's technology. Accordingly, you acknowledge that we have no control over the technology on your enrolled device, the availability, capability, verification method, security and integrity of the enrolled device and cannot be held responsible for transactions effected using the digital wallet and authorized using any biometric information or personal identification number or passcode. You should therefore assess if the enrolled device's manner of verification and risks associated with such use is acceptable to you.
4.5. You must report to us immediately if you know or suspect that:
If we so require, furnish to us a statutory declaration in such form as we specify and/or a police report and/or any other information we may reasonably require. You are liable for all unauthorized use of your RedotPay Card through a digital wallet until you notify us unless we determined, at our sole discretion that: (i) you have fully complied with these terms (including, but not limited to the safety precautions) and you notified us without delay, (ii) you assist in the investigations and recovery, and (iii) we are satisfied that such unauthorized transactions are not due to your wilful misconduct and/or gross negligence and that you have not acted fraudulently.
4.6. Unless the RedotPay Card Terms and Conditions expressly provide otherwise, you are liable for all instructions or transactions effected on your RedotPay Card through a digital wallet regardless of whether or not the transaction was authorised by you. All such instructions and transactions are irrevocable and binding on you.
4.7. The use of a RedotPay Card through a digital wallet is at your own discretion. You are not obliged to use a RedotPay Card through any digital wallet. Accordingly, you agree that the access and use of your RedotPay Card through a digital wallet will be considered as authorized by you and you shall be responsible and liable for the same. You acknowledge the ease with which unauthorised transactions may be carried out through a digital wallet and accept all risks associated with such transactions.
4.8. Without prejudice to anything stated in this Clause 4, your liability for disputed transactions on your RedotPay Card through a digital wallet effected after such loss, theft (including loss or theft of your device), unauthorised use or disclosure is as set out in our Other Terms, and in particular the RedotPay Card Terms and Conditions.
4.9. If you share your passcode with any other person, you are taken to have authorized that person to transact on your account using the digital wallet. This means that any digital wallet transaction initiated by that person using the fingerprint or passcode will be authorized by you and the clauses of the terms which deal with unauthorized transactions will not apply.
4.10. You must delete your RedotPay Card from a digital wallet before you dispose of your device or pass your device temporarily to someone else.
5. Privacy and notifications
5.1. Unless restricted by Applicable Laws, you agree that we may from time to time collect, disclose, store and use technical, transactional, location or other general or personal information and data relating to you and your use of your RedotPay Card through a digital wallet, including any information communicated to us relating to your use of your RedotPay Card and/or digital wallet in order (i) to ensure your RedotPay Card properly functions in a digital wallet; (ii) for security purposes and to identify fraud; (iii) for RedotPay to better provide assistance to you; and (iv) to tell you about other products or services that may be of interest to you,.
5.2. You further agree that we may use and disclose to such persons (whether within or outside your jurisdiction) as may be in accordance with our Privacy Policy, including to:

You may be providing your personal data and RedotPay Card details and transaction details to the digital wallet provider by registering, storing and using your RedotPay Card through a digital wallet. We have no control over the privacy and security of your personal data and information provided by you to the digital wallet provider, which is governed by the privacy policy of and any agreement you may have with the digital wallet provider.
5.4. We will also make certain account and transactional information relating to each enrolled RedotPay Card available for display on a digital wallet, and this may include information such as your most recent transactions or other data relating to you and/or the RedotPay Card enrolled in the digital wallet. Where applicable, you may be able to customise or decline having such data displayed on a digital wallet. Please check with the digital wallet provider as to whether you can turn off this feature manually.
5.5. Notification messages will be sent to you through a digital wallet by us from time to time as we deem necessary, for example, services notifications or alerting you as to any security or precautionary measures. We strongly advise that you do not deactivate the notification function of a digital wallet to receive such messages.
6. Removing, replacing and renewing your RedotPay Card in a digital wallet
6.1. You can remove your RedotPay Card from a digital wallet by following the instructions in your digital wallet, as provided by your digital wallet provider. Once you have removed your RedotPay Card from a digital wallet, you will have to re-enrol your RedotPay Card if you wish to use it through a digital wallet again.
6.2. Renewal of your RedotPay Card upon expiry or replacement of the damaged RedotPay Card will not affect your use of the same RedotPay Card enrolled through a digital wallet on your device, whether or not you have activated the renewed or replacement RedotPay Card. If you remove your RedotPay Card from a digital wallet, you may continue to use your RedotPay Card for transactions and purchases other than through a digital wallet, provided your RedotPay Card has not expired, or been cancelled or suspended.
6.3. Where your RedotPay Card is replaced, or we issue you a new RedotPay Card, we will render the original RedotPay Card inactive from a digital wallet. Once you receive your replaced or renewed RedotPay Card, you may be required to enrol your new RedotPay Card to use through the digital wallet on your device.
6.4. Your RedotPay Card may also be removed from a digital wallet as required by the digital wallet provider. Please see your digital wallet provider's terms and conditions for the circumstances in which this might occur.
6.5. For security reasons, from time to time you may be asked to re-enrol your RedotPay Card to a digital wallet. If you do not do so upon such request, you will not able to use your RedotPay Card for any purchase through a digital wallet.
7. Limitation of our liability and indemnity
7.1. You acknowledge and accept that the digital wallet is made available to you by the digital wallet provider on compatible devices. We are not the provider of your digital wallet, and we are not responsible for providing, maintaining the digital wallet service to you or other support services. We have no control over the digital wallet on your device, or your device. We are therefore not responsible for any failure of the digital wallet or your inability to use the digital wallet for any transaction. We are also not responsible for the performance or non-performance by the digital wallet provider or any third parties that may impact your use of the digital wallet. We are not responsible for any loss that you may suffer or incur in relation to your use or inability to use your RedotPay Card through the digital wallet, including, without limitation, any third party product liability claims, claims that the digital wallet fails to conform to any Applicable Laws, claims arising under consumer protection or similar legislation, and claims with respect to intellectual property infringement. Any inquiries or complaints relating to the use of the digital wallet, including those pertaining to Intellectual Property Rights, should be directed to the digital wallet provider.
7.2. We do not recommend, endorse or make any representation or warranty of any kind regarding the performance or operation of your enrolled device. You are responsible for the selection of a compatible device and for all issues relating to the operation, performance and costs associated with such compatible device.
7.3. To the maximum extent permitted by Applicable Laws, in no event shall we, our processors, suppliers, or licensors (or their respective affiliates, agents, directors, and employees) be liable for any direct, indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other Intangible losses, that result from the use of, inability to use, or unavailability of the digital wallet, including your use of RedotPay Card through a digital wallet. To the maximum extent permitted by Applicable Laws, we, our processors, suppliers, and licensors (and their respective affiliates, agents, directors, and employees) assume no liability or responsibility for any (i) errors, mistakes, or inaccuracies of content; (ii) personal injury or property damage, of any nature whatsoever, resulting from your access to or use of the digital wallet, including your use of your RedotPay Card through the digital wallet; (iii) any interruption or cessation of transmission to or from the digital wallet; (iv) any bugs, viruses, Trojan horses, or the like that may be transmitted to or through the digital wallet by any third party; (v) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the digital wallet; and/or (vi) user content or the defamatory, offensive, or illegal conduct of any third party.
7.4. Merchants may present to you certain discounts, rebates or other benefits (e.g. free shipping) ("Offers") if payment is effected through a digital wallet. Such Offers are subject to certain terms and conditions between you and the relevant merchant. We will not be liable for any loss or damage as a result of any interaction between you and a merchant with respect to such Offers. All matters, including delivery of goods and services, returns, and warranties, are solely between you and the applicable merchants. You acknowledge that we do not endorse or warrant the merchants that are accessible through a digital wallet or the Offers that they provide.
7.5. To the extent the Applicable Laws permit, you will indemnify and reimburse us (and our employees, directors, agents, affiliates and representatives) for all actions, proceedings and claims which may be brought by or against us, and for all our losses and damages, and all reasonable costs and expenses which we may incur or suffer, arising from or in connection with your enrolment and use of your RedotPay Card through a digital wallet, including but without limitation, our enforcement of these terms, unless due to our fraud, negligence or wilful default and only to the extent of direct and reasonably foreseeable loss and damage arising directly and solely from such negligence or wilful default.
